1. Who we are
Jevon Max ("we", "us") provides the AI-assisted bedtime storytelling service for families available at zingytales.com, trading as Zingy Tales. These terms are an agreement between you and Jevon Max, an individual seller operating all businesses under this legal name. By creating an account or continuing to use the service you agree to these Terms of Service; if you do not agree, please stop using the service.
2. Accounts and children
Only a parent or legal guardian aged 18 or older may create an account. Child profiles are managed by the parent from a PIN-protected dashboard, and each account can hold up to 5 child profiles. You are responsible for the activity that happens under your account, for keeping your login credentials confidential, and for providing accurate account information and keeping it up to date.
3. Free access limits
Signed-in free accounts can unlock 1 premium audio story every 24 hours, up to a lifetime maximum of 5 premium unlocks per account. Each unlocked story is automatically added to that account's Favorites. This is in addition to our 2 permanently free flagship stories (7 stories in total). Access to the rest of the library requires a Premium subscription.
4. Subscriptions, billing, and cancellation
Paid plans are charged at the interval shown at checkout and renew automatically until cancelled. You can cancel at any time from the parent dashboard; access continues through the end of the paid period. Refunds are governed by our Refund Policy: we offer a 14-day money-back guarantee from your first payment. After that window, cancelled subscriptions remain active until the end of the period already paid for. Prices are shown at checkout and may include tax depending on your location. Payment, billing, tax, invoicing, cancellation, and refund mechanics are handled by Paddle and are also governed by Paddle's Buyer Terms.
5. Merchant of record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
6. Acceptable use
Do not attempt to reverse engineer, scrape, resell, or redistribute the stories, audio, or artwork. Do not use the service to harass others, upload unlawful content, or circumvent parental controls, technical limits, or security measures (including malware, probing, or automated scraping). Do not use the service for fraud, spam, or any unlawful purpose, or in a way that infringes anyone's intellectual property.
7. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You can close your account at any time from the parent dashboard; on termination your access ends and your personal data is handled as described in our Privacy Policy.
8. Content and intellectual property
All stories, audio narration, illustrations, and site content are owned by Jevon Max or its licensors and provided for personal, non-commercial family use. Your subscription grants a limited, non-exclusive, non-transferable, revocable licence to stream and read that content within the app. If you believe content on Zingy Tales infringes your rights, contact us and we will review and remove infringing material; repeat infringement leads to account termination.
9. AI-generated content
Some stories and illustrations are generated with the help of AI tools and then reviewed by our team before publishing. AI outputs can be inaccurate, so nothing on Zingy Tales should be treated as professional, medical, psychological, or educational advice. We may moderate, filter, edit, or remove content at any time, and we do not permit the service to be used to create or distribute unlawful, hateful, deceptive, or otherwise harmful material. If anything feels off, please contact us.
10. Service availability
We work hard to keep Zingy Tales online, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. Features may change, and occasional maintenance or downtime is expected.
11. Disclaimers and liability
The service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, Jevon Max is not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.
12. Governing law and jurisdiction
These terms are governed by the laws of India, with specific reference to the jurisdiction of Chennai, Tamil Nadu. The High Court of Judicature at Madras (Chennai High Court) and the competent courts in Chennai shall have exclusive jurisdiction over any dispute arising from these terms or your use of the service, without affecting any mandatory consumer protections available to you where you live. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond their reasonable control.
13. Changes to these terms
We may update these terms as the service evolves. Material changes will be announced in-app or by email. Continued use after an update means you accept the new terms.
